Upon a petition by the Workers’ Compensation insurance Company, your benefits can be terminated by a Workers’ Compensation Judge (WCJ). In most cases the Workers’ Compensation insurance company pays for a doctor (IME), they choose, to loosely examine you and author a report finding you, the injured worker, Completely healed from the work injury. Upon receipt of the IME report, they file a petition to stop your benefits. In most cases, the IME report notes your pain Complaints but does not take into account your pain Complaints. To combat their termination petition your lawyer has you testify about your symptoms and has your doctor testify to your symptoms and why the work injury is still causing you pain. The WCJ then decides the case based upon your testimony and the testimony of the dueling doctors. 

 Our Commonwealth Court held in Hernandez v. WCAB (F&P Holding Co.), No. 1820 C.D. 2017 (Pa.Cmwlth. July 19, 2018) that even if the WCJ believes the injured worker is still experiencing symptoms from the work injury, the WCJ can still terminate the injured worker’s benefits.
